The Competition Commission of India (CCI) has introduced draft regulations for commitment and settlement procedures. Below is a snapshot of the impact on companies looking to invest in India.
The ‘Monopolies and Restrictive Practices Act’ of 1969 was enacted by the Indian government to ensure that the operation of the economic system does not lead to a concentration of economic power in the hands of a few, to keep an eye on monopolies, and to prohibit monopolistic and restrictive trade practices. This law was replaced by the Competition Act of 2002, which was enacted by the Indian government to update the archaic definitions of monopolistic practices. In April 2023, the Competition Act of 2023 was passed, further strengthening and enhancing this framework. On August 23, several new features were added to this law to ensure that newer scenarios and concepts could be brought within its scope.
The amendments allow parties to approach the CCI in cases of anti-competitive vertical agreements and abuse of a dominant position. Furthermore, they specify the content, evaluation criteria, and nature of commitment and settlement orders. This amendment also introduced a time limit for concluding applications.
Although these regulations have not yet been implemented, they represent the first step toward operationalizing the commitment and settlement frameworks. The CCI's newly proposed settlement and commitment system offers a potential lifeline for big tech companies entangled in investigations and provides opportunities to address allegations of abuse of dominant position, while simultaneously aiming to streamline regulatory processes and facilitate market adjustments.
The above-mentioned amendments aim to strengthen competition regulation, streamline operations, and foster a business-friendly environment. This, in turn, is intended to make India a more welcoming place for multinational corporations in search of talent.
